When lenders accept less than what it is owed or the full payoff, they can do one of the 3 things:
1) Nothing: Very few lenders do not do anything against you when you do a short sale.
2) Go after the deficiency: Some lenders go after the deficiency that you had, they do it through court, they usually want to put you a "deficiency judgment".

3) Send you a 1099: 3) They forgive the debt and send you a 1099 form from the deficiency,

for instance.
Your property is worth $200,000.00   
You owe $260,000.00
Lender just receives net $190,000.00
You had a deficiency of $ $70,000.00

Lenders send you a 1099 for that deficiency, why? Because for the lender was lost and even when you lost your Colorado home it means that you had an income, but guess what?

Forgiven debt is considered income by the internal revenue service IRS in the tax the lender accepted the Short Sale or forgave a portion or what was owed.

There is a new law called "The mortgage forgiveness debt relief act of 2007", Distressed Colorado home sellers and can benefit from this and can get rid this income. If you want to refinance your home and you owe more than is worth this works as well, maybe the lender will accept to refinance it and you will avoid to pay taxes from the difference (deficiency).

I took recently a seminar "Foreclosures in Colorado New Changes" and reading today's news and what I got updated in the seminar and the rest of the updates of the homes in Colorado and the situation Nationwide in many cities, Market is getting worst for many Colorado sellers in many areas, but for Colorado buyers is a great opportunity these days  that usually not happens often. 

Another great opportunity is that Colorado Buyers or Colorado Real estate Investors start buying more homes in Colorado for Rent or to lease and after these Colorado buyers retain and hold these homes for a while (some years) they will re sell them to get a good chunk from great returns.

Some issues involve many homes to be sold in Colorado, but if you are living without any hassle in your  Colorado Home, retain it or rent it until market stabilizes better.

According to the data collected in the seminar that I took in Foreclosures in Colorado we are on the 8th place from all states in foreclosures. Nevada is the 1st and California is the 2nd. I am not saying that Colorado is in better shape now. What I am trying to explain is that we started with this problem earlier than other states and right now other states as Nevada and California are worst in foreclosures than Colorado.

Market Price still going down and it is a great time to buy in Colorado.

Market Price is still going down for nearly more than half of 287 Cities Nationwide
I was reading an article today very interesting that According to MSN Money House prices are down in 147 of 287 cities Government provided that information and there are some speculations what will happen with the market or where the market is heading according to some researchers / expert in the field.

Prices in some areas are still sinking and in some others are sinking fast, that's not new, still this is a great article that you should read.

"The states with the greatest rates of appreciation between the third quarter of

2006 and the third quarter of 2007 were: Utah (12.9%), Wyoming (11.8%),
Montana (7.7%), New Mexico (7.4%), and Washington (7.0%). The states
with the largest depreciation for the same period were: Michigan (-3.7%),
California (-3.6%), Nevada (-2.4%), Massachusetts (-2.3%), and Rhode
Island (-2.2%). "

It means that Buyers in Colorado can invest in a great inventory of homes for sale today with a lot of savings, according to a seminar that I took from First American Heritage Title some statistics that they gave us Colorado is in 8th place in Foreclosures, It does not mean that Colorado is getting better overall, but it means that some other states are starting to sink more and faster for first position with more Foreclosures Nationwide and they are worst than Colorado now.

Some Basic Questions to ask when doing Short Sales

When you are starting a Colorado Short Sale Real Estate, never forget to ask some basic questions before you start the whole proces. Avoid to waste your work big time, I learned that by trial and error , but I am sharing this so you can not make the same mistake that I did once.

When dealing with a Colorado Short Sale Real Estate, never forget to ask your client (seller) whether they are current in Taxes and Home Owner Association or if they have any pending other judgments, many lenders when dealing on the final stage and dealing with the final numbers on a Colorado Short Sale Real Estate, they do not want to see on the HUD-1 that your client owes Taxes and Home Owners or other judgments or other kind of  not related or something that they tell you that is not their responsbility to pay off, just the mortgage liens

Be careful, since beginning to ask very well your client where it exists any liens against the property beside the mortgage liens or some dues that can affect your final numbers.

No one wants surprises at final, right? So, your client need to be very honest and you can get plenty of information with the title commitment to have a good idea at least where are you standing and if there is something more, you can help him/her on time
